DePuy Orthopaedics, Inc., recalled the DePuy ASR™ XL Acetabular Hip System on August 24, 2010, three years ago this coming Saturday. The three-year statute of limitations applicable to Massachusetts claims (and claims in states with a similar limitations period) could possibly expire in many cases at the end of this month. DePuy Orthopaedics, a division of Johnson & Johnson, recalled its ASR Hip System because of an exceptionally high failure rate and resulting metal poisoning. DePuy’s Pinnacle® metal-on-metal hip system, which remains on the market today but is being phased out by J&J, is experiencing similar failures.
Of the more than 10,000 DePuy ASR hip implant lawsuits pending in the U.S., only two have been decided by a jury to date. The first case resulted in an $8.26 million verdict for a retired prison guard poisoned by the implant. The second case resulted in a defense verdict. Nonetheless, the New York Times and other news sources continue forecasting that the DePuy ASR lawsuits will ultimately cost J&J and DePuy billions of dollars. Bellwether trials in state and federal court for both the DePuy ASR and Pinnacle hip systems are scheduled to go forward throughout 2013 and 2014.
Symptoms of hip implant failure may include pain in the hip area, pain in the thigh or groin, swelling, a clicking noise, difficulty rising or sitting, difficulty putting weight on the leg, discomfort while walking, or limited or reduced range of motion.
