Thornton Law Firm is co-counsel on three cases involving birth defects from parental chemical exposure at work that have been remanded to state court by the U.S. District Court for the District of Washington. This follows the remand of a fourth case on June 2, 2020. The four lawsuits, filed in King County Washington Superior Court, allege the birth defects were caused by the parents’ exposure to chemicals while working at The Boeing Company. The Complaints also named Newco, Incorporated, a Washington company, as a Defendant alleging Newco supplied Boeing with chemicals to which the parents were exposed.
The Complaints allege that the exposed parents worked at Boeing manufacturing facilities in Washington in jobs including mechanic, assembly, and printed circuit board manufacturing; and that the specific chemicals and products to which the parents were exposed include paints, primers, strippers, lead-based sealants, solvents, ethylene glycol ethers, chromate, methylene chloride and trichloroethylene (TCE).
Boeing filed motions to remove the lawsuits to federal court claiming that Newco was fraudulently joined. Following this action, the plaintiffs moved to remand and the court found that valid claims existed against Newco and that Newco was not fraudulently joined to defeat diversity.
