Four women were awarded $26.7 million in compensatory damages in the first federal bellwether trial over Boston Scientific Corp.’s Pinnacle transvaginal mesh implants. The jury ruled that the mesh implants were defectively designed, and that Boston Scientific Corp. had failed to warn doctors and patients of the device’s risks. Amal Eghnayem, Margarita Dotres, Mania Nunez, and Juana Betancourt were each awarded more than $6.5 million for their pain, suffering, and economic losses. Thornton Law Firm represents women across the country for their injuries related to defective mesh implants.
The women introduced evidence that their Pinnacle Pelvic Floor Repair Kit mesh implants caused them painful infections, scar tissue, organ damage, blood loss, painful sexual intercourse, and chronic pelvic pain. They showed that Boston Scientific hurried the products to market without proper scientific testing, and ignored internal calls for more testing. Further, the plaintiffs showed that the mesh material Boston Scientific rushed to have implanted in thousands of women had never been intended for human implantation by the company that made it in the first place.
These were the first cases tried from the federal court MultiDistrict Litigation docket which is consolidated in Charleston, West Virginia. The presiding judge, the Honorable District Judge Joseph Goodwin, transferred the cases to Miami, Florida as all four women received their vaginal mesh implants in Florida. Judge Goodwin presided over this trial.
