On Friday, March 8, a California jury awarded 65-year old Loren Kransky $8.3 million dollars to compensate him for stabbing pain, inability to walk and sleep, and metal poisoning which led his doctors to perform surgery to completely remove and replace his defective DePuy hip implant in 2012.
Mr. Kransky received the DePuy metal-on-metal ASR XL hip implant in 2007. Internal company documents exposed during the trial showed that DePuy’s own medical experts had serious concerns about the ASR XL hip design even before they were sold. Despite that knowledge, however, DePuy marketed and sold the ASR XL model hips from 2005 to 2010. DePuy stopped making the ASR hip replacements in 2009, but continued to sell them for another year, until recalling them in 2010. It is estimated that approximately 100,000 patients received ASR hips worldwide. DePuy is a division of Johnson & Johnson. A spokesperson for Johnson & Johnson indicated that the medical giant would appeal the verdict.
Mr. Kransky’s case was just the first to go to trial. Thousands of other suits are pending in State and Federal courts around the country for both the DePuy ASR XL hip system and DePuy’s Pinnacle metal-on-metal hip system which remains on the market today. Additional suits are expected to be filed as the DePuy hip replacements continue to fail.
