A second DePuy ASR hip implant case scheduled for trial this month has been resolved, according to court records.

The lawsuit, MacDonald et al v. DePuy Orthopaedics Inc. et al, was filed in the Bergen County division of the New Jersey Superior Court and was scheduled to go to trial on October 21, 2013 before the Honorable Brian R. Martinotti. There are few details about the settlement available at this time and, as with prior Depuy hip settlements, the terms will likely remain confidential.

As we wrote in an earlier post, pretrial settlements are positive news for anyone injured by DePuy ASR hip replacement devices. Bellwether trials or test trials, provide valuable insight into how juries might rule in similar cases. Additionally, trials are expensive and time consuming, and the waiting time for a trial date can go on for years. Being able to obtain a settlement that adequately compensates an injured party in a reasonable time period, without the expense and uncertainty of trial, is a benefit to the injured party.
